This User Policy sets out the terms between You and Us under which you may access our Website and Mobile application at www.briquetales.com (hereinafter referred to as the “Our Platform”). This User Policy applies to all Users and visitors of Our Platform.

Before using Our Platform, procuring our services, the User shall read and understand this User Policy. User’s continued use of Our Platform means that User accepts and agrees to abide by, all the policies including this Policy, which supplements our Terms of Service as a binding document that governs User’s transactions/relationship with Us. If the User does not agree with any part of this Policy, then the User must not avail our services. To be able to use our Platform, if an individual, User must be atleast 18 years of age. However, such age criteria shall not be applicable to User if User represents an organization or any artificial person (legal entity).

www.briquetales.com is a Website is owned, operated and maintained by Midaspace Private Limited (“We” or “Us”). We are a Private Limited Company registered in India under The Companies Act, 2013 having our registered office at C/o Elegant House, Raghuvanshi Mills Compound, Senapati Bapat Marg, Mumbai – 400013, Maharashtra, India.

User Registration
User is required to register and set up an account for shopping / purchasing products from our Platform by entering his/her following mandatory personal details to sign up for an account on Our Platform: full name, email address, age / date of birth, mobile number and residential address. Our Platform may ask for the verification of the information provided by the User like email address and/or mobile number etc. and hence, it is advisable to provide valid information and upon creating the User Account. Our Platform will set-up an account upon verification of the email address and mobile number provided by the User. Post such registration, User shall be required to share his/her credit card details, debit card details, bank account details (as the case may be) at the time of purchase of any products from Our Platform.
User can create only one User Account and such account shall not be permitted to transfer or interchanged with any other person. The type of information required to be provided by the User to register on Our Platform, usage of such information, protection and confidentiality of such information are more specifically dealt with in Our Platform’s Privacy Policy (client to insert hyperlink here) and the Users are requested to read the Privacy Policy in detail before sharing their information or creating an User’s Account on Our Platform.
Violation of content available:
All the content available on Our Platform, including but not limited to audio, videos, images, text and such similar content (“Content“) is protected under applicable intellectual property laws for the time being in force. User is not allowed to use/exploit this Content for any other purpose, except as specified herein. Except as expressly provided in the Terms of Service, no part of Our Platform including but not limited to the Vendor Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including ‘mirroring’) to any other computer, server, website or other medium for publication, distribution or any commercial enterprise without the Our prior written consent in that regard.

Our Platform does not grant any of its User any right, title, interest, license or authority to utilize such proprietary logos, service marks, or trademarks in any manner. Any unauthorized use of the Content, will be in violation of the applicable law.

Prohibited uses:
User may use Our Platform only for lawful purposes. User represents, warrants and undertakes to not use Our Platform:

In any way that breaches any applicable local, national or international law, rule or regulation.
In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
For the purpose of harming or attempting to harm minors in any way.
To hack and/or enter into without lawful means to any portion of Our Platform.
To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
You also agree:

To not reproduce, duplicate, copy or re-sell any part of Our Platform in contravention of the provisions of our Terms of Service.
To not access without authority, interfere with, damage or disrupt:
Any part of Our Platform including any other user’s account Yours and/or access any vendor’s account;
Any server/cloud/equipment/network on which Our Platform is stored;
Any software used in the provision of Our Platform; or
Any equipment or network or software owned or used by any third party.
Access to any features of Our Platform viz. may only be available to registered User(s) of Our Platform. The process of registration, shall require User to answer certain question/s or provide certain information that may or may not be personal in nature. Some of such fields may be mandatory or optional. User represents and warrants that all information provided to Us while at the time of User registration and/or otherwise is true and accurate. User shall provide correct and accurate information to be able to register on Our Platform and the same shall be as under:
First and Last name;
E-mail Id;
Age / Date of Birth;
Mobile No.;
Company Name, if any;
Residential Address;
The registration page shall prompt to send a One-Time Password (OTP) to the email ID provided by User to verify the same and to set a password if the correct OTP is entered which shall enable the User to access Our Platform.

Suspension and termination:
We will determine, in our discretion, whether there has been a breach of this User Policy through your use of our Platform. When a breach of this Policy has occurred, We may take such action as We deem appropriate.

Upon acceptance of Terms of Service. User is permitted to use Our Platform. Failure to comply with this policy constitutes a material breach of the Terms of Service. Breach of Terms of Service may result in our taking all or any of the following actions:

Immediate, temporary or permanent withdrawal of your right to use our Platform.
Immediate, temporary or permanent removal of any posting or material uploaded by you to our Platform.
Issue of a notice of warning to you.
Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
Further legal action against you.
Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
We exclude liability for actions taken in response to breaches of this Policy. The responses described in this policy are not limited and we may take any other action we reasonably deem appropriate.

User Account and User Content
User agrees that User will be solely responsible for any and all User Content that User posts on Our Platform and for the User Account created using Our Platform. Specifically, you agree, represent and warrant that you have the right to create or post the User Content and/or User Account and the right to use all materials of which it is comprised and that it will not contravene any aspect of Our Acceptable Usage Policy, detailed in clause 6 hereinbelow.
User agrees that User will be liable to Us and will, to the fullest extent permissible by law, indemnify Us for any breach of the warranties given by you under clause 3 hereinabove. User will be responsible for any loss or damage suffered by Us as a result of such breach.
User will retain ownership of User Content and User Account and all intellectual property rights subsisting therein (except to the extent that a User Account incorporates Content belonging to Us (including, but not limited to, that forming part of Our Platform). By creating or uploading User Content and/or User Account, User grants Us an unconditional, non-exclusive, fully transferable, royalty-free, perpetual, worldwide licence to use, store, archive, syndicate, publish, transmit, adapt, edit, reproduce, distribute, prepare derivative works from, display, perform and sub-licence the same for the purposes of operating [and promoting] Our Platform.
If User wishes to remove/delete any or all of the User Content or User Account, User may do so by contacting Us. Removing/deleting any or all of User Content and User Account also revokes the licence granted to Us to use the same. User acknowledges, however, that caching or references to the User Content and/or User Account may not be made immediately unavailable (or may not be made unavailable at all where they are outside of Our reasonable control).
We may reject, reclassify, or remove any User Content and/or User Account created or uploaded using Our Platform where, in Our sole opinion, such User Content or User Account violates Our Acceptable Usage Policy, or if We receive a complaint from a third party and determine that the User Content or User Account in question should be removed as a result.
We respect the intellectual property rights of others. If a User notices any act of infringement on Our Platform, User is requested to send us a written notice/intimation which must include the following information:
Clear identification of such copyrighted work that User claims to be infringed;
Location of the material on our Platform, including but not limited to the link; of the infringing material;
The proof that the alleged copyrighted work is owned by User or such other person not related to us;
User’s Contact information;
Acceptable Usage Policy
User may only use Our Platform in a manner that is lawful and that complies with the provisions of this clause. Specifically:
User must ensure that User complies fully with any and all applicable local, national and international laws and/or regulations;
User must not use Our Platform in any way, or for any purpose, that is unlawful or fraudulent;
User must not use Our Platform for unauthorised mass-communications, commonly referred to as “spam” or “junk mail”;
User must not use Our Platform to knowingly send, upload, or in any other way transmit data that contains any form of virus or other malware, or any other code designed to adversely affect computer hardware, software or any data of any kind; and
User must not use Our Platform in any way, or for any purpose, that is intended to harm any person or persons in any way.
The following types of content is not permitted on our Platform and User must not create, submit, communicate, link to, or otherwise do anything that:
is sexually explicit;
is obscene, deliberately offensive, hateful, or otherwise inflammatory;
promotes violence;
promotes or assists in any form of unlawful activity;
discriminates against, or is in any way defamatory of, any person, group or class of persons, race, sex, religion, nationality, disability, sexual orientation, or age;
is intended or otherwise likely to threaten, harass, annoy, alarm, inconvenience, upset, or embarrass another person;
is calculated or otherwise likely to deceive;
is intended or otherwise likely to infringe (or threaten to infringe) another person’s right to privacy or otherwise uses their personal data in a way that you do not have a right to;
misleadingly impersonates any person or otherwise misrepresents your identity or affiliation in a way that is calculated to deceive (obvious parodies are not included within this definition provided that they do not fall within any of the other provisions of this sub-clause);
implies any form of affiliation with Us where none exists;
infringes, or assists in the infringement of, the intellectual property rights (including, but not limited to, copyright, patents, trade-marks and database rights) of any other party; or
is in breach of any legal duty owed to a third party including, but not limited to, contractual duties and duties of confidentiality.
We reserve the right to suspend or terminate any User Account, the availability of, and/or User’s access to Our Platform if a User materially breaches the provisions of this clause or any of the other provisions of Terms of Service. Specifically, We may take one or more of the following actions:
Suspend, whether temporarily or permanently, that User Account and/or User’s right to access Our Platform;
Remove any of User Content (or any part thereof) which violates this Acceptable Usage Policy;
Issue to User a written warning;
Take legal proceedings against User for reimbursement of any and all relevant costs on an indemnity basis resulting from your breach;
Take further legal action against you as appropriate;
Disclose such information to law enforcement authorities as required or as we deem reasonably necessary; and/or
Any other actions which We deem reasonably appropriate (and lawful).
We hereby exclude any and all liability arising out of any actions (including, but not limited to, those set out above) that We may take in response to breach of this Policy.
